Even An Atrocity Does Not Justify Destroying The Bill Of Rights

The murder of 20 innocent children and 7 adults in Newtown, Connecticut, horrifies all Americans. President Obama eloquently expressed our collective feelings of “overwhelming grief” and our response to “hug our children a little tighter, and we’ll tell them that we love them, and we’ll remind each other how deeply we love one another.”

Progressives now are arguing for stricter gun control. America, however, is founded on the “consent of the governed.” Americans’ sympathy for gun control, when polled by Pew after the Aurora atrocity, was about equally split between the restrictionists and those favoring the protection of the right to bear arms.

Restrictionist sentiment is down from almost 2 – 1 in favor of gun control in 2000. This isn’t irrational. Empirically, at 12.1 victims per 100,000 the firearms death rate in ultra-restrictionist Maryland, home of this columnist, is higher than that of gun-friendly Texas’s 10.9 per 100,000.

    Not in Obama’s view. This tragedy absolutely must be used to advance his political agenda. Take the people’s guns, and take their freedoms!!

    Why is the preamble to the Bill of Rights is almost never published or talked about? One reason that the preamble is almost never published or talked about is that it destroys all arguments about Articles in the Constitution (treaties etc.) that are used to destroy our rights. To refresh our memory the preamble is as follows:

    Preamble to the Bill of Rights

    Congress OF THE United States begun and held at the City of New York, on Wednesday the Fourth of March, one thousand seven hundred and eighty nine.

    The conventions of a number of the States having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added. And as extending the ground of public confidence in the Government, will best insure the beneficent ends of its institution.

    RESOLVED by the Senate and House of Representatives of the United States of America, in Congress assembled, two thirds of both Houses concurring, that the following Articles be proposed to the Legislatures of the several States, as Amendments to the Constitution of the United States, all or any of which Articles, when ratified by three fourths of the said Legislatures, to be valid to all intents and purposes, as part of the said Constitution:

    ARTICLES in addition to, and Amendment of the Constitution of the United States of America, proposed by Congress, and ratified by the Legislatures of the several States, pursuant to the fifth Article of the original Constitution.”

    The key phrase here about the body of the Constitution is “in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added”. That means that any clause, treaty or law that goes against the principles of the Bill of Rights is null and void, even if based on the Articles of the main Constitution. And yet, what BAR attorney uses this argument in Court to defeat treaties and laws that are in conflict with the Bill of Rights.

    Now you know WHY the preamble is seldom published or taught.

      Thank you Sir. Most Americans have no idea of the Bill, or its’ intent. We can only bow to our forefathers as EXTREMELY wise men that literally planned or EVERY contingency.

    Why should I be punished for someone else actions. Gun Owners have rights too. Have the law makers every heard of the Consitution and the bill of Rights?

    The progressives ( ie: communists ) do not need reasons to destroy the constitution and bill of rights , they just need excuses . They can pass all the gun laws and executive orders they want , my only gun law is the second amendment of the bill of rights .

    All this tragedy plays right in stupids hands. Exactly. I could never judge anyone’s heart in all this, but the past four years I’ve seen a mastermind at work… the gears in his head just keep turning. 2013 is going to be the true wake up call….. such a loser…..

    The atrocity is the teachers that willingly give up their lives and the lives of the children for somebody elses agenda.


    “I will no longer enter a school classroom until I and all other school employees and teachers are trained and armed to PROTECT AND DEFEND my self and the children of my classroom!”

    If you are trained and comfortable with the idea of killing any person intent on doing harm, then go armed tomorrow and demand a FULLY INFORMED JURY.

    FORCE the government to defend their laws.

    Deal with the amoral and unaccountable society, and the “gun problem” will take care of itself! That’s what’s at the root of these violent outbursts, and until it’s fixed the guns will continue to be a problem as will any and all other weapons!

      How many more have been saved from criminals due to their firearms ownership? Hint, a lot more.

      Of course, this does not even account for the deterrence effect that broad firearms ownership has had on the possible development of tyranny by our government. Just ask the Germans, Armenians, Chinese, Russians, Cambodians, Africans, and others how well civilian disarmament has worked out for them? Hint, genocide sucks. Don’t be so ignorant of history before commenting on the BOR.

    This so typical of progressives, pass a one size fits all law and everything will be OK. Well one size never fits all, It is not possible. Some may think it will but it will not. I bought my wife a nightgown one year for Christmas and it was one size fits all. It was so huge it was made by Omar the tent maker and she promptly took it back. I learned my lesson.

    The fix is to train and arm school teachers and administrators so that they can defend themselves and their charges. The deterrent effect will make it unlikely that they will ever have to defend anyone. The problem we face is that progressives don’t care as much about the shootings as they care about shredding the inconvenient constitution. The mass shootings are just an excuse for them to get fired up and excited about gun control. Remember, these people never let a good crisis go to waste.
