Court rules N.Y. shooting victim can sue gun maker, distributor

A Buffalo man who was shot nearly a decade ago can sue the manufacturer, the distributor and the dealer of the semi-automatic pistol used to shoot him, a New York state appeals court ruled on Friday.

Attorneys for Daniel Williams, who was shot in 2003 when he was in high school, argued that Ohio-based manufacturer Beemiller and the distributor, MKS Supply, violated federal law by knowingly supplying guns to irresponsible dealers.

The defendants said they cannot be sued because of the federal Protection of Lawful Commerce in Arms Act, a 2005 law that shields firearm manufacturers and sellers from liability for harm caused by the criminal misuse of their non-defective products.

    This judge is an idiot. So if I have a car accident in New York, I can sue G.M. or Ford whatever, plus the dealer that sold me the car, and how about New York if I’m using their roads, and if I just filled up the car with gas from N.Y. and because of the accident the car went on fire, now I can go after the gas station, the oil companies, hell maybe even the friggin arabs if the oild can from there. Hey judge you really need to think things out, unless you are just an anti-gunner, you jerk.

      It’s New York. Of course the judge, the south end of a north bound mule, is an anti-gunner.

    October 6, 2012 at 6:02 pm does that mean those who have been stabbed can sue knife manufactures. Hmmm lets see in jails they often use pencils as weapons so can an injured inmate now sue pencil manfacturers. Some people were badly beaten with baseball bats and hammers…so can they sue those manufacturers also.
    Oh and lets not forget women who have been strangled with their own pantyhose…can they sue also?
    This means alot of instant millionaires, of course it always means the end of manufacturing in this country but hey we don t need jobs lol and we can all happily poison ourselves with the cheap crap we now get from china,

      That makes sense to me if they allow gun manufacturers to be sued for illegal use of firearms they produce. So all these gang fights with knifes allows someone hurt by a knife to sue the knife manufacturer. Give it a break. The lawyers love this kind of logic. Will keep them in business forever.

    Obama causes me pain by making me pay taxes for things that I don’t agree with. Can I sue him and the IRS also? If noy,then why not? One makes just as much sense as the other.

    Let’s be honest here, the “victim” was likely a thug shot by another thug.

    The article states Williams was shot while in high school, he was likely living the ‘thug life’ and paid a price for his bad decisions. Now he wants to cash in on his bad decision by suing the maker of the gun and possibly putting the company out of business.

    Sadly the liberals and the judge are standing behind this freeloader in his efforts.

    Conservatives need to take the Country back.

      Doesn’t say what he was doing or had been doing just prior, and the Buffalo shooting didn’t make a lot of news in AZ, but whatever it was is immaterial, except to possibly make his claim all the more spurious; the suit is inane to start with! If he was suing the SHOOTER, I could understand, but this is just one more grab after our 2nd Amendment rights by intimidating folks from making and selling guns!

    Ok, so if a certain auto manufacturer’s car is involved in an accident and that accident results in a death, the car maker can now be sued. Crazy.

    Next we’ll be suing auto manufacturers and dealers for being in car accidents and injured! When do people learn that sometimes Sh$% happens even to “nice” people and life has RISKS attached to living it??? If they want to stay in the womb, better they DON’T get born! But it’s not up to society to protect and coddle them from cradle to grave; or government to do so either!

    Judges everywhere are spitting on their oaths. They, like all politicians, should be accountable when they break their oaths as if they are simple campaign promises made to be broken. Until they are held accountable, it will just get worse and worse.

    Sounds like we need to sue the government for letting criminals, illegal aliens, and terrorists live here and cause harm to the citizens. They should govern this country properly, so those things do not happen to our innocent citizens.

    New York has to be one of the most socialistic states this country has ever had the displeasure of ever having to put up with. Talking about a stupid ruling, and with this in mind, all auto manufacturers would fall under this same rule.
    I have yet to hear of any auto manufacturer getting sued due to criminals running over their victims causing injuries. This rule is out of context with common sense in every respect!!!!
    Also, ANYTHING that is used to commit bodily harm would fall under this rule. Where would it end if NY continues to have their way with their arrogant supidity??
    The good citizens of NY need to send those fools packing and be done with them, along with Bloomberg.
    What a messed up system they have!!

    I wonder what would happen if all of a sudden gun manufacturers and dealers packed up and left New York and other states and refused to sell and/or do business there. I bet you would see a whole different story!!

    So this means that if I get hit by a Ford, Chevy, Toyota etc in a car accident I can sue the car mfg, the dealership, all the parts mfg, the City, State and the company the put the road in because they’re all responsable. What if I choke on food in a resturant? Can I sue the resturant, the chef, the delivery company that delivers to the resturant, the farm the food came from. The judge needs removed from the bench. If this is allowed every retail outlet and every manufacturing company in America will be facing frivolous lawsuits.

    I accidentally bit myself the other day, can I sue my dentist? What about the toothpaste, toothbrush or mouthwash manufacturers? Now that I got past the humor, here comes the main course: WHO IS PROVIDING THE FUNDS FOR THE ATTYS, hmmmmm?? This is all about bankrupting gun manufacturers & any small business that takes part in the process after the firearm leaves the manufacturing firm, you know, people that can’t afford to fight in court against the deep pockets of Geo Soros or the government – – – hmmm, they might as well be one in the same from the looks of our once super great nation, ya think? I know that I am preaching to the choir, but this election that we are going to participate in con mucho gusto on Nov 6th (Nov 7th for commie/lib dems) is, without a doubt the most important election in our lifetimes & mine has lasted nearly 77yrs so far! Everyone on this page, I assume is going to vote for Mitt Romney, so our charge is to get someone you know to vote – that is, unless he is an Obamaliar supporter!!!! ‘Scuse my rant, but trust me, it is much abbreviated!!!
