Manchin, Toomey close to deal on “expanded” background checks; Update: Deal reached

“Expanded” in this case is … a term of art, as you’ll see shortly. As Harry Reid tries to find the votes to have a vote on his gun-control package in the Senate this week or next, two key players say they are close to an agreement on the central piece of the bill. Joe Manchin (D-WV) says that he and Pat Toomey (R-PA) will have a proposal on expanding background checks for gun sales at shows and on the Internet. The package will contain a requirement by the sellers to keep records of all background checks, but apparently not a federal registry.

As the Senate gears up for the first fight over new gun legislation in two decades, Republicans do not appear to have the votes they need to execute a planned filibuster on Thursday and a bipartisan breakthrough is likely, according to one Democrat.

    These checks are only supposed to be kept by the gun sellers and not to be federal……hahaha.

      In 1966 the newly forming ATF/FBI came and took our single shot .22 bolt action pistol that had been a registered gun since 1958. Since then I only buy ammo for trading purposes. They change the laws to make you criminals, just like King George did.

      Exactly. We already HAVE gun registration, if you think the feds have not been storing and saving every single background check hit in a database you are crazy. They may not know WHAT you own, but they know you own. And that’s enough for them to send a SWAT team to your door when they start their disarmament plans.

      There is already in place a back door gun ‘registration’ for the federal government. Obamacare has a question required of doctors – does the patient have a firearm in the home? The feds don’t necessary need to know how many or what kind – simply what homes have them and which ones don’t.

      Check this information from an attorney in Indiana – this may not be your state but as it’s a federal question and can result in a federal penalty, it may well apply in your state unless your legislature has done something to negate it:

      Specifically, it is a federal penal act to make a false statement relating to heath care matters in collection with payment for medical services by health care benefit programs. A “health care benefit program” is any public or private plan or contract under which any medical benefit, item, or services is provided to any individual. 18 U.S.C. §24(b).
      To the extent health care provide is included within this definition, the failure to disclose firearms subjects the person to fine or imprisonment up to five years or both. The verbatim controlling statutes is as follows:
      “Whoever, in any matter involving a health care benefit program, knowingly or willfully falsifies, conceals, or covers up by any trick, scheme or device a material fact; or makes any materially false, fictitious, or fraudulent statements or representations, or makes or uses any materially false writing or document the same to contain any materially false, fictitious, or fraudulent statement or entry in connection with the delivery of or payment of health care benefits, items, or services, shall be fined under this title or imprisoned.” 18 U.S.C. § 1035.

        That is why one must NEVER answer any firearms questions at a doctor’s office and never ever discuss anything related to weapons with the doc. Say you will not provide private confidential information that has no relation to your medical condition and if they pursue then leave. You have the right to pick your doctor (for now…:< ), so go find another one. I predict in the following months doctor's office visits will be heavily dropping.


    Pure and simple the idea of gun control is nothing more than politics gone overboard and the inability of these people to enforce the gun laws just like they cannot enforce the immigration laws because all they want is to make sure they get re elected.
    I think from now on all of these phony opportunistic jerks need to pass the US citizenship test and prove they have a working knowledge of the Constitution…I propose they all be publicly drug tested every year and randomly during the year and they give up their tax paid security…

    What is ‘apparent’ (when it relates to gun registration) is not good enough for me. I want to see a bill that specifically states that there shall be no gun registration system created or allowed, whether locally or nationally.

    Don’t be so quick to “Judge”. While I am just a “simpleton” and am unable to to understand with the same level of judgment as our elected leaders, After the bill is actually written, we may find out that it would prevent those above the law from selling guns to “Drug Cartels”.

    The talk on gun control in Congress and the media should only revolve around “…the RIGHT of the PEOPLE to KEEP and bear arms, shall NOT BE INFRINGED.” Do they have the right to infringe or not. The 2nd protects all the others & without it, there is no Constitution of, by and for the PEOPLE. Short ropes should be in short supply, not ammo!

    As a Pennsylvanian, I had hopes that when we got rid of Single Bullet Arlen Specter, that there was hope that we would finally have a representative in Congress, as opposed to Obama’s rubber stamp Senator Zero (Casey)…

    Apparently they don’t know that any legal sale by a dealer at a gun show or retail outlet requires a background check and that sale is recorded and kept by the dealer for inspection by ATF at any time.There is a paper trail to the original owner that remains.No background check will ever stop a criminal from getting a gun either on the street or by stealing it himself.All these laws are already in effect, this is nothing but a waste of time so that administration can show that it’s doing something to control violence. Violence in and of itself can NEVER be stopped, example, a mentally deranged young male at a Texas college wounded 14 people with an X=acto knife yesterday.

      Try this for size, I purchased a long gun in Florida fifteen years ago. I live in Illinois, I tried buying another long gun at the same shop and was told they would have to mail to a FFL holder in Illinois. Could not believe it.


    Leave us the heck alone…Damnable government…But here in Arizona we have the turncoats of the like of McCain and Flake and Flake lives up to his name…Ron Gould was running for Senate and was a man of principles. If only he could have swung the votes. But the bad guys get to buy the votes or whatever they do to get elected to make our lives worse and worse…Where are the rest of our heroes. We should be able to block any move by the dems…we have cowards to represent us.


    Why don’t they make some laws that would actually be helpful to some of the American People. That would be a nice change. Not them, just go for the throat anytime they can…OOOFS.

    While at a Hardee’s in Durham, NC, I struck a conversation with a man I’d never met. I*’d been deer hunting with my brother and, noting the camo, he began to talk about guns. He told me this,”I just retired from Langley, VA and we have a record of every gun sale for the past 25 years.” I told him that that was illegal and he just looked at me and shrugged as if to say ‘Oh well’. This was about 6 years ago.

    Let’s just don’t fight for the second amendment let’s fight for all of our rights as stated in our bill of rights. Forth amendment is being trashed at airports and vehicle stops. The tenth amendment is being ignored with incroching federal unconstitutional power grabs. The first amendment is on thin ice look at the restrictions placed up on us in our house(the white house) or in certain state legislative floors. Sure there are more rights of ours that are god given rights that are being infringed.

    Again they are relying on the law abidingg to continue abiding by the law.

    The other option is for the BATFE to conduct compliance visits to residents homes to see if they had acquired any new firearms.

    But wwait you say, how can they verrify that withouut firstt knowing what firearms are already in your possession.

    The can’t. Hence the response from the Dept. of Justice thhat aadvised that tthis bill will not be efffective unless it is couplled with a national gun registry.

    Keep writing your reeps ffolks. This is jjust the start of rouund two in a maajor priize fight.
