Texas AG to Obama: I’ll sue if U.N. Arms Treaty is ratified

Texas Attorney General Greg Abbott wrote a letter to President Obama on Tuesday saying that the state will head to court over the United Nations Arms Trade Treaty should Mr. Obama sign it and the U.S. Senate ratify it.
“The UN has concluded its negotiations on the Arms Trade Treaty,” Mr. Abbotwrites. “It is now up to you to sign it — or reject it. Do not sign this treaty.”

Mr. Abbott writes that he understands the apparent purpose is to combat illegal arms trafficking around the world, but that the treaty could draw law-abiding gun owners and gun operators “into a complex web of bureaucratic red tape created by a new department at the UN devoted to overseeing the treaty.”

“As with most so-called international-law documents promulgated by the UN, the draft treaty is not written using the precise, unambiguous language required of a good legal document,” he continues. “Instead, the treaty employs sweeping rhetoric and imprecise terminology that could be used by those who seek to undermine our liberties to impose any number of restrictions on the right of law-abiding Americans to keep and bear arms.”

      WRONG!!!! According to the Constitution, any treaty, signed by the president and ratified by the Senate, amends and overrides previous tenets of the Constitution. In this case, even though the Supreme Court has ruled in favor of individual ownership and use of firearms, any way that the UN decides to stick it to us overrides the 2nd amendment. Period.
      The only way to argue this is to say that the Presiodent and Senators disregarded their oaths to defend the constitution. But I believe that will fail, for the court would have to recognize that international treaties are a means to amend the constitution in an entirely Constitutional manner.
      I just hope that the UN uses a condom when they tell the US citizens that the General Assembly is now in control of our government — Obama says so.

    What possibly would keep the President from signing this treaty? This is exactly what he wants and a way around the negative liberties enumerated in the US Constitution. The sooner he can get rid of that pesky Constitution the sooner he can ‘Free’ this country from the shackles of individual liberty.

This treaty places our sovernty in the hands of 192 member stares; most of which are dictatorships with virtually no civil rights.       This is what happens when we listen to much to the tea party and let them push the party so far to the right in moderate to left leaning states that we lose Senate seats. Harry Reid was toast in the polls against either of the “normal” Republican Candidates, then the Tea Party Express came to Vegas and proclaimed Sharon Angle “the only one pure enough.” Two huge mistakes were made. The people didn’t like her–she was probably the only person in NV at that time that couldn’t beat Harry Reid. Then her inane minister went around calling Mormons (Reid is one) a Cult when the Mormon community in Las Vegas (though only 7%) is very well respected and politically powerful. The stats that favored the others by 60/40 were reversed and Reid now holds the Senate hostage for years yet to come. Then there was Delaware. When this gun treaty is ratified we have only ourselves to blame for being politically stupid.

    I believe that if President Obama signs this UN Treaty, under the Geneva
    convention, it will be considered law as along as Obama is president (think a
    presidential order). It will not matter if the Senate votes it down or not. This
    is serious and we all need to make as much noise as possible now, just like the
    AG of Texas is doing. The general population might not realize this (ignorance
    will be the death of our republic as we know it), but the second amendment
    guarantees US citizens arms…it is the glue that holds the rest of the
    amendments together, and ensures our God given rights. Without them, history
    shows that government will take away our rights as soon as people have no
    credible recourse. Please call you government representatives, get your friends
    involved, and speak out against these foreigners trying to collapse the great
    experiment, where people are supposed to govern themselves.

        Ed, legally it would not be treason. The US entered into the Geneva Coventions willingly. Our own Consitution holds treaties as good as consitutional law. If the UN agrees on a Small Arrms treaty and Obama signs it, he can obligate us to the treaty as long as he is President….without a Senate vote. Watch for the Blue Hats!!

      Article I, Section 10, paragraph 1 declares: “No State shall enter into any Treaty…”
      All civil magistrates are bound by oath to abide by the U.S. Constitution, and nowhere in the U.S. Constitution is any authority given for these United States to be subject to and bound by any earthly piece of paper that abrogates or is alien to the Constitution of the United States. As a matter of fact, Article VI, paragraph 2, the latter half of which is quoted at the outset above, in its first half, says only three (3) pronouncements are “the supreme Law of the Land”:

          You can read the Geneva Convention and you can believe what you like — The US Constitution is not a suicide pact and common sense says Barako Bomber can sign anything he likes and we are not held as subjects to merely obey.

          • There have been several declarations by the Supreme Court affirming that no treaty can supercede the rights and provisions of the Constitution as amended. So even should the Senate ratify the treaty (highly unlikely, given the 2014 election situation) no provision of it can act contrary to the Constitution.

      Other states are doing things. I believe that Wyoming has passed a law that federal officials cannot enforce a law in Wyoming that is not covered by the Constitution. There are other ones as well. My current state won’t because of all the welfare slugs in Philly and Pittsburgh. They outvote people with functioning brains, but I’m headed back west myself. I won’t stay in a place where people who only take from the taxpayers and do nothing useful in their lives elect the officials. Bloomberg’s pouring money in here to strong arm his views into our lives. Too bad New Yorkers didn’t get rid of him a long time ago!

        In Australia, the nice law-abiding citizens politely handed over their guns. How did that work out? They are seriously considering reversing that decision! On 22 May 1969 the Leftists in the US Congress had already laid the groundwork for this day with the Vienna Convention. They created that Act by which UN Treaties subjugate the US Constitution. An Act in itself that was unconstitiutonal, Now, all that has to happen for this UN Treaty to become US law is for the US President not to oppose it, which he won’t. Because, Obama is reveling in it’s adoption. And, as long as the US Senate is not allowed to bring the ratification up for a vote, which Harry Reid will never let happen. The Un Treaty becomes US Law by default. Now, what the h*ll are we going to do about our US Constitution only being, “An interesting document” (obsolete), as Obama called it? I, for one, am absolutely fed up with Marxists playing the race card when we oppose the man sitting in our White House, whoever he is.
