Justice Stevens: You Have the ‘Constitutional Right’ to Call 911, Not to Own a Gun

Retired Supreme Court Justice John Paul Stevens says your right to self-defense in your own home should be limited to a cellphone “at your bedside.”

Stevens, 92, served on the Supreme Court for 35 years before retiring in 2010. A liberal jurist, Stevens wrote the dissenting opinions on both the 2008 Heller ruling and the 2010 McDonald decision, both of which were 5-4 affirmations that the Second Amendment protects an individual’s civil right to keep and bear arms.

As the guest speaker during an Oct. 15 luncheon hosted by the anti-gun Brady Campaign to Prevent Gun Violence in Washington, Stevens offered a suggestion to millions of Americans who legally keep a weapon in their home for self-defense.

    I’d like to see how fast the police will arrive when Stevens’ home is broken into. He’s out of touch, and dementia has set in.

      Ask the judge if he’s ever been fired at or what would he do if someone broke into his home and had a gun or knife. You have the right to protect your family and yourself from someone breaking into your home. I guess the thing is if you shoot the perpetrator you MUST kill him to ensure your not sued.

        To kill the invader to keep from winding up in a lawsuit is something that the Castle Doctrine Bill addresses. This portion of the bill states that the invader has NO rights to file suit due to language such as that he was their for No Good Reason. So far, i haven’t heard of anyone shooting and wounding an invader who was taken into court and sued for injuring the bad guy.
        Every state, that I am aware of, passed this doctrine bill when they passed the CCW bill. It was designed for our protection, not the bad guy’s. It was also designed to put the invaders on notice as well that we have the right to stand our ground.

          In CAL. they will not pass the castle doctrine, in fact the gov that we have is passing just about every anti gun bill that comes across his desk. If you even cause injury to an intruder here in CAL not only will the intruder sue you but so will the state.

            Sounds like a state that I would not want to live in unless I WAS a trespasser. And I suppose the intruder has all the right to kill you if you try to apprehend and detain. Must be the smog over there that has made their brain soft and malfunctioning.

          Maryland routinely prosecutes those who protect their homes and businesses with firearms. Invaders also enjoy cash payouts if injured during their commision of said crimes. Lib land is not ruled by logic.

    When seconds matter, police are only minutes away.

    Several police depts. nationwide have announced that it not their job to protect citizens, only to investigate crime. That makes the citizen responsible for their own protection. Stevens is a m0r0n.

    It’s a good thing that he retired. In his senility, he has obviously forgotten “Castle Rock v Gonzales” in which I believe he participated. The court (SCOTUS) ruled that (I paraphrase) :
    1. The police have no duty to any individual, only to the public at large.
    2. Personal self defense is the responsibility of the individual.

    Following his somewhat flawed thought process, one would conclude that we, who have thus far erroneously believed we were citizens with unalienable rights, are reduced to a state somewhat less than serfdom. Since the police have no duty to come to our aid, and the good justice would remove our most effective tool for self defense, we are little more than cattle, awaiting slaughter.
    Remember, when seconds count, the police are only minutes away. If nothing else, this comment serves as an abject lesson in the importance of electing a conservative president and a conservative senate.

      Amen! Each citizen is protected by the Second Amendment to bear arms for self-defense protection and to “Stand Your Ground” against such criminals. I would not live in a State that restricts the individual citizen’s right to self-protection.

    There should not only be limits to 2 terms in any branch of government (House, Senate or Presidency), including any combination thereof; there also should a limit of appointments to the SCOTUS for only 2 Presidential terms or 8 years. Start making children learn the meaning and principles of the Constitution and other founding documents, along with our history, and the constant new blood in government will revitalize this republic.

    MY FELLOW AMERICANS:STEVENS should have not have been on the bench at all if He never realized that 911 is NOT in any way mentioned in the Constitution, 2nd. the average response for a 911 police call to be responded to is 23 minutes, the factual time of .357 is 1400 ft per second and then the 22 minute wait for the Police to arrive and save the day.,or do it as Stevens suggests, and in 23 minutes the Police can call the corenor and hall the Bodies away from the scene along with the Cell Phone,WHAT A DOORKNOB.!!!!!

The Brady Campaign just wants someone to tell them what they want to hear, and this old fart will do that. He needs to retire from public life, and crawl into a hole.     Stevens is right – you have a right NOT to own a gun. But that does not negate the plain meaning of the 2nd Amendment that the government has no power to prohibit or ban gun ownership. Just because HE sees no need to own guns, he thinks that’s the end of the discussion. It seems that the more educated some folks are, the more they think their opinions should count much more than others. Our society is a violent one, what with drug abusers, alcoholics, haters, racists, over-prescribed psychiatric drugs and criminals who could care less about consequences. If we were to ban guns our crime rate would skyrocket as thugs turned to edged weapons and blunt instruments to commit their crimes. My trusted .38 has never killed anyone and hopefully never will. I consider it like a life-vest. It’s a life-saving device that can save my life, or that of my wife, child, neighbor, friend and possibly even the criminal.

    What’s amazing is how DUMB he is on the Supreme Court’s view on the 2nd Amendment–he simply will not admit since it’s inception in 1789, the U.S. Supreme Court has NEVER ruled against the 2nd Amendment being a Constitutional RIGHT!! HISTORY of the Court is against Stevens, itself. On top of that, the 14th Amendment enforces that right against state governments trying to obstruct citizen’s rights: Section 1 of the 14th Amend: “No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.” Stevens needs to bow out and GET OUT of our 2nd Amendment rights–44 of U.S. states have the 2nd Amendment ADOPTED IN THEIR STATE CONSTITUTIONS.

    “A well regulated” means in the lexicon of the times means “well trained” “militia” refers to a pool of men between the ages of 17 & 45 to be drawn upon in case of a national emergency & not the Nat’l Guard like the anti 2nd Amendment bozos want us to believe – you see the Guard did not exist in 1789 when the Bill of Rights was ratified. “Being necessary to the security of a free state” means just what it says & needs no clarification. “The right of the people” means that it is a God given right, not given by any government & “the people” is found in 5 of the original 10 Amendments to the Constitution, aka the Bill of Rights & it refers to the general population. “to keep & bear” means to OWN & CARRY, “arms” means any firearm capable of use by an individual. “Shall not be infringed!” which means that the gov’t cannot change one bit of the meaning of the 2nd Amendment, even tho many states & cities have been violating our Constitutional rights for far too long! Stand @ the ready!!!!!!

    Justice Stevens needs to be removed from office immediately, , he has forgotten the meaning and purpose of the Second Amendment, “Being Necessary for the Security of a Free State”, and he seems to have also forgotten , “Judges are appointed for periods of Good Behavior”….NOT lifetime as some want us to believe…Article 3 US Constitution The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services aCompensation which shall not be diminished during their Continuance in Office.
